1. THE PARTIES.

    This Buyer Agency Agreement (“Agreement”) made on ___________________ (date) is by and between: Buyer: ______________________________________________________________ (“Buyer(s)”), and Agency:____________________________________ (“Agent”) of ___________________________________ (“Agency”)

    Collectively, the Buyer and the Agency shall be referred to as the “Parties”. If for any reason the Broker is not able to fulfill their duties under the terms and conditions of this Agreement, another agent from the Agency may be appointed during the Listing Period of this Agreement. Any person or entity that the Buyer enters into a contractual agreement for real estate shall be referred to as a “Seller” in this Agreement.

  2. THE PARTIES.

    Buyer hereby agrees to hire the Agency on a(n): (check one)

    • Exclusive Basis. The Agency helps buyers acquire real property exclusively through various means like purchase, option, exchange, trade, or lease. The Commission is payable even if the buyer acquires property independently without the Agency’s involvement.
    • Non-Exclusive Basis. When working with the Agency on a non-exclusive basis, the Buyer owes a Commission only if they acquire real property with the Agency’s assistance. If the Buyer purchases property without the Agency, no Commission is due.
  3. PERIOD OF AGREEMENT.

    This Agreement shall start on _______________ (mm/dd/yyyy) (“Effective Date”) and end on _______________ (mm/dd/yyyy) at 12:00 midnight, unless the expiration date is extended in writing.

  4. COMPENSATION.

    The Agency may receive compensation from the Listing Firm or seller, to be credited toward the Buyer’s fee. For the services rendered by Agent, Buyer agrees to pay Broker a fee (the “Fee”) equal to:

    • _________% of the gross purchase price of the property acquired by Buyer; AND/OR
    • the sum of $_________________.
  5. AGENCY DISCLOSURE.

    Buyer acknowledges that this Agreement establishes a relationship with the Agency. The Agency will cooperate with other agents, share compensation with listing agents, and handle payments to other agencies as standard practice.

  6. FAIR HOUSING.

    Agent agrees and adheres to the standard of showing real propertie made available to the Buyer without regard to race, color, religion, age, handicap, familial status, or national origin.

  7. DISCLAIMER.

    Buyer acknowledges that the Agent is not an expert in legal, tax, financing, or property conditions. The Agent advises Buyer to seek expert assistance for these matters and makes no warranties regarding the experts’ services, property condition, or suitability for Buyer’s needs.

  8. FALSE INFORMATION.

    Buyer agrees to indemnify the Agency and hold harmless for claims arising from false information provided.

  9. LEGAL SIGNATURE.

    This Agreement may be executed and delivered by any party herein by by a legally recognized digital or electronic signature. Such legal signature shall be binding on the party so executing it upon receipt of signature by the other party.

  10. GOVERNING LAW.

    This Agreement shall be governed under the laws in the State of the Agency’s location.

  11. SEVERABILITY.

    This Agreement remains in effect if any section is deemed unenforceable or invalid. All other sections remain binding, and any affected provisions will be enforced as limited.

  12. ADDITIONAL TERMS AND CONDITIONS.
  13. ENTIRE AGREEMENT.

    This Agreement constitutes the entire agreement between the Buyer and Agent and supersedes all prior discussions, negotiations, and agreements between the Buyer and Agent whether oral or written. Any understanding, agreement or promise shall bind neither Buyer not Agent, expressed or implied, not specified herein.

  14. SIGNATURES.

    This Agreement is intended to be the legal and binding agreement of the Buyer and Broker. The Parties acknowledge receipt of a signed copy of this Agreement.
